Our Terms and Conditions are described in the rental contract. Also the same conditions are mentioned below for customer reference. TERMS AND CONDITIONS:
1. Rental agreement will be effective from the date and the time its’ signed until the vehicle is returned.
2. If any documentation is required by a third party and renter has to request the company ; then it should be in written form and at least a 48 hours time frame should be allocated for AAA GREEN RENTALS to respond to the request.
3. Rent will be charged for the complete day of vehicle delivery and receiving irrespective of the time of each instance, rent is calculated as per a calendar day.
4. Renter is responsible to organise their own E-Tag devices or to register vehicles to their toll account from the date and time they take possession of the vehicle. In case, if renter does not take the required measures and toll invoices are received by the company; then each toll invoice we receive and will have to be nominated under the renter’s name and this action will reflect $5.50 charge per invoice as an admin fee, and renter will have to pay this charge. Also all infringement notices which we may receive from respective authorities will require nomination, this action will reflect the admin fee of nomination at the rate of $10.50 per infringement (speeding/red-light/littering/parking etc).
5. The renter will have to ensure to return the vehicle back in the same condition as it has been handed over to them. Windshield cracks/deep stone chips, which will require windshield replacement, will reflect the windshield replacement excess of $450.00. That amount covers the down time duration of vehicles being repaired and being organised for repairs.
6. The renter takes sole and complete responsibility to ensure that the above-mentioned vehicle will not be used directly or indirectly in any shape or form for or in any illegal activities under the Australian (all states) transport laws and criminal laws.
7. If the hired vehicle is impounded by the law enforcement resulting in an over-speeding or hooning incident; then all the relevant costs will be paid by the renter along with the loss of rent for that duration.
8. If the above-mentioned vehicle is found to be involved directly or indirectly in any illegal activity then AAA GREEN RENTALS possess the right to recover its vehicle back without any prior notice.
9. By signing the rental agreement/contract AAA GREEN RENTALS has been given the absolute right to repossess the vehicle back at any point of time without any prior noticing to the renter; if due rent hasn’t been paid on time and after 24 hours of grace period is over.
10. If AAA GREEN RENTALS finds out or has been informed about any suspicious conduct by the renter involving the company's vehicle then AAA GREEN RENTALS will have the absolute right to recover the vehicle without notifying the renter.
11. During the entire rental period, renter will be solely responsible to pay all the driving related infringements, parking infringements, toll road invoices and overdue payments incurred on the hired vehicle for the entire rental duration.
12. Vehicle is rented out for personal use, but renter is not restricted from using it for commercial purposes. Although, AAA GREEN RENTALS will not be responsible for any harm or damage caused to any third party during its vehicles private or commercial use by the renter.
13. AAA GREEN RENTALS can not be held responsible for any kind of delays or discrepancies renters may face on the way of using the vehicle with any rides-hare or commercial platforms. And rent will be charged as per the contract stated amount from the date and time of vehicle's dispatched until its return date and time.
14. This vehicle is covered with comprehensive insurance cover for private use as well as for ride-share and commercial use. Renter will be added as a registered driver in the insurance policy and will be subject to follow all the terms and conditions of the insurance company. Insurance company is a third party providing us the service and we have no control or authority on the insurance company.
15. In the event of an accident: If the vehicle is involved in an accident; the renter must report the incident to us. And also will have to report the incident directly to the insurance company on its' provided contact details as per the insurance cover letter. This action must be carried out immediately as the time deadline to report the incident has been set out 24 hours by the insurance company to lodge the claim.
16. Renter will be required to fill out the forms to lodge the insurance claim within 24 hours from the time of the accident. Also, if the vehicle is safe to drive then renter should present the vehicle to AAA GREEN RENTALS office for damage assessment within 48 hours from the time of the accident.
17. INSURANCE Excess must be paid in full within 24 hours from the time of accident regardless of being at fault or not. If the other party involved is found to be at fault by the insurance company. Then Paid excess will be reimbursed into the renters provided bank account. Excess amount is age subjective. ($1,500.00 for above the age of 25 years and $1,800.00 for the drivers under 25 years of age) No Coverage provided for the driver under the age 21, and No coverage for unlicensed and suspended driver under the policy; and renter will be responsible to cover all damages caused to the hired vehicle and to third party property involved. Renter must abide by all the insurance terms and conditions stated in the insurance cover document. (In failure to comply with clause 11 and 12 Rental Company and Insurance Company both have a right to disregard the claim).
18. If un-nominated driver is found to be driving the above-mentioned vehicle and causes any accident results in damaging hired car or third party property then renter is solely responsible to cover all losses; Also this action will be considered as a breach of the contract, and this agreement will be immediately terminated by AAA GREEN RENTALS and company will pursue to recover the vehicle without any prior notice.
19. It is important for the safety of the other drivers and road users that any driver that drives this vehicle should have a valid drivers licence and must be added in the respective insurance policy to be covered in any unwanted event of accident.
20. Weekly rent cycle is for SEVEN CALENDAR DAYS and each day will be calculated separately at the end of the rental period in the rental statement prepared by the AAA GREEN RENTALS's account department.
21. There will be direct debit deductions of the weekly rental payment (for the long term renters) all the third party (direct debit company) dues and costs will be paid by the renter. In failure of direct debit payments third party will charge the payment failure fee, renter will have to bear that cost. And no cost liability will be passed on to the AAA GREEN RENTALS.
22. Rental price will be discussed, negotiated and agreed upon by both the parties and will be mentioned in the contract.
23. Weekly payments will incur $20.00 per day additional LATE FEE if payment is delayed for more than 48 hours.
24. Renter is responsible for sending the odometer readings on a weekly basis to AAA GREEN RENTALS so the company can ensure the routine maintenance and servicing schedules are carried out on time for the safety of the driver and car both by AAA GREEN RENTALS.
25. AAA GREEN RENTALS will bear the cost of routine maintenance and servicing, and general wear and tear. 26. Driver is responsible to notify the AAA GREEN RENTALS about any strange development in performance or appearance of the hired vehicle. Delaying to notify will pass the responsibility to bear the cost from AAA GREEN RENTALS to the renter as it will be considered as an act of deliberate negligence causing intentional damage to the vehicle.
27. (Flat tyre) and blown up tires or any damage to the tires resulting in puncture will not be covered under the wear and tear category. AAA GREEN RENTALS will not cover the cost for tyre puncture repairs or tyre replacement cost due to damage caused by driving with a flat tyre. Renter will be solely responsible for the repair or replacement cost. (It is also highly recommended for Renter to properly check all the tires before taking possession of the car to avoid any inconvenience).
28. Roadside assistance is only available within the 100 kms radius from Melbourne CBD and usual time for roadside assistance to arrive is approximately 2-4 hours.
29. If breakdowns occur outside the determined radius then all the towing cost will be paid by the renter where the vehicle needs to be towed away.
30. Renter should immediately notify the company's representative if renter feels the wheel alignment is off or if the vehicle is strangely putting to the either side of the road, also if the wheel alignment went off after taking the car then renter must immediately notify the company to avoid causing unnecessary damage to tires.
31. Aggressive driving behaviour, harsh cornering and hitting the bumps too hard may result in putting the wheel alignment out of the line and it may cause unnatural wearing of tires. And the cost of the tyre replacement for unnatural wear will be passed on to the renter. Natural life cycle of tires is around 50,000 kms which can be verified with the last invoice of tires being replaced on rented vehicles.
32. All kinds of malicious damage, damage caused by negligence while driving, drink driving, will not be covered by the AAA GREEN RENTALS. And renter will be solely responsible for all the consequences.
33. In the event of natural disaster such as hail storm (hail-damage), flood damage, fire or if the vehicle gets stolen during the rental period; and or vehicle being vandalised in all the above scenarios, renter will be bear the cost to pay for the damage, and renter can claim the event through the insurance after lodging the claim and after the excess being paid in full to the insurance company.
34. Renter will be responsible to pay for the cost of key replacement in the event of car keys being lost and also will have to bear the rent for the down time while replacement keys are being organised.
35. Renter is responsible to return the vehicle back washed and cleaned from outside and properly cleaned and vacuumed inside (or in the same condition as it was at the time of disposal), if the vehicle is brought back in dirtier condition then what it was at the time of delivery. Then the renter will have to pay the cleaning fee of $25.00 for outside wash and $25.00 for inside clean. If both types of cleaning are required then each segment cost will be charged separately. If the car is returned with dirty wheels and covered with brake dust then $10.00 per wheel detailing charges will be applied separately or $25 outside wash fee applied.
36. If the vehicle is returned either with odour (bad smell), or visible stains of the seats or carpet then renter will pay for the cost of $100.00 for steam cleaning.
37. In case if the hired vehicle is dropped off to another location other than the company's address; or if AAA GREEN RENTALS have to collect the vehicle from another location; then $150.00 (drop off on a different location charge) will apply for the distance within 10 kilometres from the company's address. And additional $5.00/kilometre charge will apply for each kilometre outside the radius of 10 kilometres.
38. If a vehicle is returned outside working hours of between (10:00 am to 5:00 pm Monday - Friday) and (11:00am to 1:00 pm Saturday) or anytime during public holidays or Sunday it will reflect an outside normal hours fee of $100. (This option is subject to availability of the staff members); otherwise cars should be brought back during the normal trading days and trading hours only.
39. AAA GREEN RENTALS has been authorised by the renter through signing this agreement to recover all the outstanding dues using direct debit or any other payment method authorised by the customer for signing this rental contract or to make regular payments. (if the security bond is not sufficient to cover the costs).
40. Minimum of $500 security bond and one week advance rent is required upfront. Security bond will be refunded within 14 business days from the date of return of the vehicle and conducting the assessment of the vehicle’s condition and sorting out the outstanding tolls and infringements. If a company receives any fines or toll invoices after the vehicle is returned then the company may hold the security bond for additional 7 business days to sort out the tolls and fines prior processing the refund.
41. Two weeks prior notice is required before returning the vehicle, if the vehicle was hired for long term rental. This two weeks notice period will not overrule the duration of the initial contract.
42. Company has the absolute right to ask for the return of the vehicle at any point of time during the rental agreement duration.
43. Once the notice of return has been submitted by the renter, then the company can request the customer to return the car immediately, or can let Renter keep the car until 2 weeks notice of return period is over.
44. If renter fails to comply with two weeks notice of return condition it will be considered as a breach of contract, and wants to proceed with early termination of the contract; then either, security deposit or two weeks rent the greater value will be paid by the renter as the compensation against the breach of clause 43. 45. Renter is required to report the company in the event of any minor/major accident immediately and renter is not authorised to carry out any kind of repairs without the written consent from the company or company's representative in the form of text message or email.
46. If the renter has carried out repairs on their own, then the company will still have a right to claim the cost to cover the damages as compensation of losing the lifetime warranty on the repairs, if the vehicle was repaired by the insurance company otherwise.
47. In case of body panel damage on one or more body parts; or deep scratches occurred on the body of the vehicle, (Repair cost can vary between “$300 to $3000" per body panel depending upon how extensive the damage is). It will be solely the company's discretion to get it repaired from its choice of repairer.
48. Renter can request to get the car repaired without going through the insurance claim; if company and renter both can reach an agreement to get the car repaired without going through the insurance claim then that settlement will be only to cover the damages caused to the AAA GREEN RENTAL's vehicle and it will not pass any kind of responsibility for any damage cause to third party property.
49. If the renter persists to choses the option of not lodging the insurance claim then there will be no coverage to any third party property damages under the insurance policy for that particular event.
50. If the rent was temporarily reduced due to lockdowns being enforced by the authorities; then, as soon as the lockdown is lifted from the next date rent price will return to the normal price of the contract, if any concession was offered during the lockdowns at the first place.
51. AAA GREEN RENTALS does not provide vehicles for interstate travelling. Although, if the renter decides to take the vehicle interstate then 50% additional rent charges will be applied to the entire rental duration if the rental contract is for less than 1 month. An additional $0.10/km will be applied for those with contract duration over 1 month during interstate travel, kilometres will be determined using Google maps and daily average of 200 kms will be applied for each day while the car is used interstate at the rate of $0.10/km.
52. Renter will be solely responsible for towing the vehicle back to our office address in Melbourne, if vehicle is broken down outside 100 kms radius from Melbourne CBD or broken down outside the state during interstate travel; otherwise will be billed for the towing charges.
